Philippines : CA halts NTC proceedings on GLOBE s bid to take over BAYANTEL [TendersInfo (India)]


(TendersInfo (India) Via Acquire Media NewsEdge) The Court of Appeals has stopped the National Telecommunications Commission s (NTC) proceedings on Ayala-headed Globe Telecom Inc. s takeover of Bayan Telecommunications Inc.

"In light of the circumstances, we find that there is compelling need to preserve the status quo so that the instant petition will not become moot and academic. Indeed, petitioner stands to suffer if the NTC proceeds to hear the joint application up to judgment without the instant petition being first resolved," a resolution from the CA s special sixteenth division read.



The CA is referring to the motion filed by Philippine Long Distance Telephone Company (PLDT), which discussed that the takeover violates Republic Act No. 7925 or An Act to endorse and Govern the Development of Philippine Telecommunications and the Delivery of Public Telecommunications Services PLDT argued Globe s takeover of the mobile frequencies of Bayantel. The Manuel Pangilinan-led firm said the frequencies should be open to all competent applicants in a competitive bidding procedure.

Globe s purchase would mean its access would go up to 95 MHz of frequencies. Bayantel has 50MHz for 4G bandwidth. Via subsidiaries Smart Communications and Digitel, PLDT has access to 35Mhz for the 4G bandwidth.
